Buyer:

Jiangyin Chemical Fiber

 

Buyer requirements:

Buyer is a polyester staple fiber manufacturing enterprise, that requires long term supplies of PET bottle flakes, condux (pop corn), fiber scrap and other PET waste materials. Buyer has strong financials and all proper import documentations.

 

Seller requirements:

Seller shall be a legal, and trustworthy entity. Seller shall be experienced in manufacturing/brokering, logistics and international financial transactions, and must be able to provide or accommodate AQSIQ and CCIC certificates.

 

Seller qualifying procedure:

Seller shall provide information on supply capacity, acceptable payment terms, certificates of quality, pictures and actual samples of the product.

 

Quality requirements:

Buyer accept seller's product sample and certificates of quality at good faith. Buyer has the right to claim on quality of the final product if buyer feels that actual product quality is inferior than that of the sample. 

 

Moisture requirements:

Seller shall compensate for moisture weight of more than 1%.

 

Weight requirements:

Chinese customs weight shall be considered as the final net cargo weight. Seller shall compensate for any weight shortages if the total net cargo weight is 100kg less than invoiced weight.  

Seller shall also compensate for excess moisture.

 

Packaging and logistics:

Seller shall try to load as much weight as possible into each container. Unless agreed by buyer, seller shall NEVER load more than one type of product into the same container.

Buyer accepts CNF and CIF Shanghai terms.

 

Payment and shipping schedule: 

Buyer shall make an advance deposit within 7 days of signed contract. Goods shall be on board vessel no more than 15 days after date of advance deposit. 

Seller shall present evidence of shipment no less than 5 business days after loading. 

Buyer shall remit following payment in less than 5 business days after receiving evidence of shipment,

Seller shall then, in less than 3 business days upon receiving payment, mail out all required documentation to:

Documentation: 

- 3 sets of Commercial invoice with seal

- 3 sets of Packing list with seal 

- Full set of clean on board BL marked "freight prepaid"

- CCIC one original and one duplicate

- Pictures of loading

- Proof of at least 14 days free demurrage

- In CIF, insurance policy

 

Claims:

Buyer shall have the right to make claims to the seller for financial losses incurred due to seller's errors or non-performance of contractual obligations.

For quality related claims, buyer shall submit claims with test certificates within 30 days of cargos' arrival to destination port.

For other related claims, buyer shall submit claims with evidence within 90 days of cargos' arrival to destination port.
